Power

declares (n) by this instrument, to grant Dr. Lilia María FERNÁNDEZ LEÓN and Mr. Osmel AROCHE PÉREZ, a special power so broad and quite which by right is necessary for any of them to collect before the Offices and Authorities that correspond in the Dominican Republic, the registration of trade names, product brands, service marks, copyrights, sanitary and agricultural records of products, new plant varieties or any other type of industrial or intellectual property, as well as renovations, assignments, name changes, mergers, amendments licenses and to execute any act or contract related to them; to request patents for inventions, models and industrial designs and utility models, and the registration of assignments, changes of the owner’s name, address and mergers, registration of licenses and any other act and contract related to them; to obtain evidence of the use of registered trademarks; deduct oppositions, lawsuits, appeals, claims of nullity or cancellation of records; to take criminal actions in case of violation of the rights of the principal and perform all acts that are required for the purposes indicated. For this purpose they expressly grant the power to appear before any civil, administrative or criminal court; to act as plaintiff or defendant, accept requests, demands, responses and other requests; to prepare descriptions and amendments, pay taxes and other obligations; to bring all legal resources, receive money and values; to accept any other legal obligation necessary to protect the principal’s interest. This power includes the power to substitute this Power in whole or in part and to revoke substitutions.

Osmel AROCHE PÉREZ, a special Power as ample and sufficient which by Law may be necessary in order that either of them may to request from the corresponding offices and authorities of the Dominican Republic, the registration of any trade names, trademarks, service trademarks registrations, copyrights, sanitary and agricultural registrations of products, new plant variations or any other type of industrial or intellectual property as well as the registration of renewals, assignments, changes of name, mergers, amendments and licenses; to execute any other contracts or acts related there; to apply for invention patents, industrial and utility models and designs, and registration of their assignments, changes of owner’s name and address and mergers, registration of licenses and any other acts and contracts related therewith; to obtain evidences of use of trademarks; to file oppositions, claims, appeals, demand the nullity or cancellation of registrations; to initiate criminal actions in case of infringement of the mandator’s rights and to carry out all procedures thereby required. For this purpose the attorney is hereby expressly granted the power to appear, before any Court of civil, administrative or criminal jurisdiction; to act as plaintiff or defendant, to submit applications, demands, responses and other petitions, motions or request; to prepare descriptions and reforms, to pay taxes or any other obligations; to take all legal resources, to receive monies and valuables; to comply with any other legal requirement necessary to protect the mandator’s interest. This power includes the faculty to delegate this power of attorney and to revoke such substitution or assignment.
